Well the documents from today’s SGI hearing are now online, and available for viewing. I am not a lawyer, but from perusing them a bit I see:
- Most of the day it seems was spent discussing the objections from Cray and Intel (Docket #344 and #345). It seems these are going to be debated further, at a date “no sooner than May 27th”. In the interim, Rackable will continue to negotiate directly with Cray and Intel to avoid it going to court.
- Most of the schedule it seems was rescheduled to be heard on June 3rd, according to docket #351.
- Docket #353 seems to clear SGI of being forced to continue to lease Office and Parking space at 5975 South Quebec Street, Suite 200, Centennial Colorado, 80111.
- Docket #346 – 349 seem to resolve objections brought by SpectraLogic, LSI, Raytheon, and SuperMicro. The settlements:
- Rackable has 10 days to pay $892,000 to SuperMicro, and will assume all of their open contracts with SGI
- Rackable has 10 days to pay $70,000 to SpectraLogic, and will assume all of their open contracts with SGI.
- Rackable will pay $523,000 to LSI by May 15th, and assume all of their open contracts with SGI.
- Rackable will assume all of the open contracts with Raytheon, and fulfill SGI’s obligations.
And that seems about it. I guess we can add about another $1.5mil onto the amount Rackable is gonna pay for SGI, due to these settlements.
You forgot the dismissal of Eliot Bernstein’s motion at the SGI hearing, the best part of the day??? Wait for the forthcoming motion by Bernstein charging all involved with fraud. In fact, watch the other Bernstein cases in federal court at the same time, that all involve fraud by SGI and their former company Real3D. Fed Judge Shira Scheindlin in a case legally related to Bernstein’s federal complaint has just scheduled the case for trial of a Whistleblower from the New York Supreme Court Appellate Division First Department who claims wide scale public office corruptions and obstructions of justice. The Whistleblower names Iviewit, Bernstein’s companies in her original complaint.
